California Microstamping Law Not In Effect

Flawed Technology Remains Encumbered by Patents

NEWTOWN, Conn. -- Firearms microstamping, signed into by  Gov. Arnold Schwarzenegger (R-Calif.) in October 2007 and slated to take effect this New Year's Day (2010), is not in effect since the technology remains encumbered by patents. Microstamping -- the process by which firearms manufacturers would have to micro laser-engrave a gun's make, model and serial number on two distinct parts of each gun, including the firing pin, so that in theory the information would be imprinted on the cartridge casing when the pistol is fired -- must be certified as patent-free by the California Department of Justice before the law can go into effect.

Though microstamping cannot be certified because the technology remains covered by patents, last month the California Department of Justice issued proposed regulations for the technology, a move that was questioned by the National Shooting Sports Foundation (NSSF) -- the trade association for the firearms industry.

"In the midst of California's budget crisis and despite the possibility this law may never go into effect -- as the technology remains encumbered by patents -- one has to question the decision by the California Department of Justice to spend its time and limited resources on drafting regulations for the flawed technology," said NSSF Senior Vice President and General Counsel Lawrence G. Keane.

Opposition to microstamping has intensified as manufacturers have indicated the new law would force them to raise prices of guns significantly. Estimates of price increases go as high as $200 per firearm, as the unreliable technology would require a complete reconfiguring of the manufacturing and assembly processes.

The National Shooting Sports Foundation (NSSF) is the trade association for the shooting, hunting and firearms industry. Formed in 1961, NSSF is a not-for-profit organization with a membership of more than 5,000 manufacturers, distributors, retailers, sportsmen's organizations and publishers.

Take a stand

All gun and ammunition manufacturers and suppliers should stop selling any gun related items in Kalifornia. Don't sell to the public sector either. It would be very tough for gunshop owners, but maybe they could sell approved Sierra club items. It would be a pricipled stand, following Barretts lead.
Good luck good citizens. Vote the bums out and change the laws.

Oh yeah, the gun companies would not want to break a law about microstamping, even when that law is not can not and will not be enforced. This is another erosion to peoples understanding of the law. It seems as though regular people are being conditioned to the fact that if you don't like a law, don't follow it. Which of course is wrong. If the Republik of Kalifornia dropped all the laws that are not enforced, or are out dated, I would imagine more people would be able to follow the law. Then the legal system needs to enforce the laws.
Maybe all of America could do the same thing. Just a thought.

This technology is complete garbage. The powers that be think it will help solve crimes as the spend ammo casings will be left at the scene of the crime. Tell me what about revolvers? a type of gun that retaines its spent ammo. To me that would be a god selling pin for revolvers. Not only do they NOT jam they dont eject ther casings. Giving the shooter the ability to keep the casings and getting rid of them at will. This whole thing is a farce. What about ALL the firearms that are out there that do not stamp ammo? So what if they stamp the ammo. Anyone with half a brain will eventually realise that all they need to do is attach a bra*s catching device as simple as a ziplock bag to the ejector port of the gun using duct tape to hold it inplace. Since there is no gas pressure that is significant enough to blow of the bag off the gun it will catch the bra*s
Oh gee multimillion dollars worth of research and developing has just been disabled by a one cent bag or a simular more appealing device that will no doubt be invented to clip on to the firearm. Like I said this is a farce. Ths technology did do one thing good though. It made my non microstampping guns much more valuable.

Didn't Bring Revenu - Won't Stop Crime

Recall how the CA budget and the whole state is on its butt! They had all that time to develop useless laws like this? Also, they refused any meaningful technical input. I'm all for a total prohibition on sales and service to LE. Let them feel that kind of heat so they have to be just like everyone else without badges to hide behind or make special purchases with. No one else can use a badge to buy a gun or a box of ammo.

The people of Kalifornia that elected the fools that enact this sort of legislation only have themselves to blame. Why do they put up with it? Many good points here. If this technology is ever made to work, and it won't mostly due to trademark infringement, it will only make it that much more important to the bad guy to make sure he doesn't use a new gun that has this feature when they commit the crime. With the millions of arms that are already in the hands of people, this is not a problem. When will the people of this state get wise to the fact that it's foolish legislation such as this that has them bankrupt. The Police departments and Law Enforcement of that god awful state tell the people making these laws that they won't help, but they don't listen. Has any of these laws kept the Kommunist republic of Kalifornia from the scurge of gun crime. Take a ride through the bowels of LA, watts, oakland San Fran or any other slum. After you have been carjacked at gunpoint and probably shot numerous times for just being there, post me your opinion. I choose to live in a state that gladly issued me a permit to carry a concealed handgun because I'm an honest, law abiding citizen. They don't fear me because they have no reason to. Try to take my wallet, car or threaten the well being of my family or myself, and your going to be dealing with some big .45 ACP holes in your torso and cranium. Michigan is a good place to live if for this liberty/freedom alone. I won't dial 911 until the threat has been eliminated and it's time to write up the report. It's what law enforcement ends up doing 99.9% of the time in Kalifornia too, filing a report and never arresting the person responsible. Unfortunatly it's usualy just a death report for the victim.

Kalifornians vs Californians

Kali has about 38 million people. The most politically liberal and anti-gun populations of Los Angeles (Co. pop. 11 million), Sacramento (Co. pop. 1.5 million), and the San Francisco BayArea (7 million) make up 19.5 million; just more than 1/2 the total population. Now, obviously NOT ALL PEOPLE in these areas are brainwashed, but this does illustrate my point; that the majority of Kali's population is comprised of big-city, big-government-minded people who need others to think for and do for them. It IS THESE WHO HAVE A POLITICAL DEATH-GRIP ON CALIFORNIA AND THE REST OF US WHO LIVE HERE. They think that more laws and more police will STOP crime.
We all know this to be a fallacy. The more stringent and regulatory a society, the more subversive the criminal element will become (the former USSR is prime example). Joe citizen is totally oppressed by the police state while Joe criminal thrives!
Please don't lump Californians in with the "Kalifornians". May the big one come and Kalifornia slip into the Pacific Ocean! Buy Nevada ocean front property now!

Why I moved out...

I recently retired from military service. I moved out of California as quickly as I could. Couldn't afford the cost of living and couldn't stand the firearms laws. Folks like Jerry Brown, Gavin Newsome and Villaraigosa pretend to care about the "public welfare" but all they really care about is keeping THEIR CONTROL of things and people in that state. There are a mere handful of REAL TAXPAYERS left in CA compared to the size of the population. That state will go under real soon. And, Californians, if you move somewhere else, don't ask for all those darned social services you had in CA...they COST MONEY! No rapid transit, no modern art museums, and no abortion clinics funded by the taxpayers...leave the liberal crud behind, if you move out. Thanks.
