Here We Ago Again: Ridiculous 'Hate Crime' Legislation Print E-mail

 The U.S. Senate is expected to take begin consideration on passage of Ted Kennedy's ridiculous "hate crime" bill known as the "Matthew Shepard Hate Crimes Prevention Act" (S. 909)  Kennedy's bill is a rehash of the same absurd and dangerous legislation he's been trying to ram through Congress for more than a decade. The "Findings" section in the legislation, which is used to justify passage of the S. 909, uses the same ridiculous claims that have been used for years.

Those "Findings" listed in Section 2 of the bill solemnly state (without any basis in fact) that:
Such violence substantially affects interstate commerce in many ways, including the following: (A) The movement of members of targeted groups is impeded, and members of such groups are forced to move across State lines to escape the incidence or risk of such violence.

(B) Members of targeted groups are prevented from purchasing goods and services, obtaining or sustaining employment, or participating in other commercial activity.

(C) Perpetrators cross State lines to commit such violence.

(D) Channels, facilities, and instrumentalities of interstate commerce are used to facilitate the commission of such violence.

(E) Such violence is committed using articles that have traveled in interstate commerce.
Traditional Values Coalition exposed these fraudulent findings in H.R. 1913, the House version of this legislation. Democrats were so embarrassed by these embarrassing and untrue claims that they removed them from H.R. 1913 during the mark up of the bill.

Senator Ted Kennedy (D-MA) apparently has no shame. He's including these false findings once again in this bill to justify federal involvement.

Let's briefly analyze these "findings." First, no Representative or Senator has ever tried to justify these findings as factual. Why? Because these findings are clearly false.

Kennedy claims, with a straight face, that LGBT persons (lesbian, gay, bisexual, transgender) are so persecuted by angry bigots that they are fleeing across state lines to avoid being beaten up.

These mythical LGBT persons also have trouble finding employment or engaging in "commercial activity."

But, it gets worse, according to the esteemed Senator: Not only are LGBT persons regularly fleeing in large numbers across state lines, but they're being pursued by angry bigots across these state lines. These bigots are also apparently using "instrumentalities of interstate commerce" to commit these mythical crimes against LGBT persons. I wonder where these bigots purchase their "instrumentalities of interstate commerce" - at Wal-Mart?

I suspect that if there were large numbers of gays, lesbians, bisexuals, and drag queens fleeing across state lines for the past decade, there would be some record of this mass migration. Surely, Highway Patrol officers of the 50 states would have seen these mass exoduses from one state to another.

All of this nonsense in the findings is a pretext to justify federal intervention in state law enforcement by invoking the interstate commerce clause of the Constitution.

Senator Kennedy should be forced to provide actual evidence of his claim that there's been this mass migration of LGBT individuals across state lines for a decade. And, he should be forced to prove that bigots are pursuing these poor terrified persons across state lines. Can he provide us with a bigot's  "instrumentality of interstate commerce" seized by a Highway Patrol officer?

Senator Kennedy Won't Let Facts Get His Way!

As TVC has stated repeatedly in our battle against passage of so-called hate crime legislation: There is no epidemic of hate against LGBT persons in America.

FBI hate crime statistics prove our point: FBI statistics on "hate crimes" against a person's sexual orientation from 2007 (the latest available) reveal the following: In 2007 there were 1,521 victims of "sexual orientation" bias (Table 7). However, the breakdown of these crimes is listed as:
  • 335 were crimes of intimidation (shouting or name-calling)

  • 448 were crimes of simple assault (defined as pushing or shoving without physical injury)

  • 242 were crimes of aggravated assault (defined as bodily harm)

  • 9 bias murders were committed.

In short, there were only 242 crimes against a person's sexual orientation that could be considered "violent." And, twenty-seven of these bias crimes were directed against heterosexuals! All together, there were 9,535 victims of bias crimes in 2007. This includes bias against race, religion, sexual orientation, ethnicity/national origin, disability, or multiple-bias incidents. 

The FBI statistics do not indicate how many of these "violent hate crimes" were committed by homosexuals against other homosexuals - or what provoked the violence.

 Out of a total number of 855,856 cases of aggravated assault in 2007, only 242 were directed at LGBT individuals. This is only 0.02827578411446785% of all aggravated assaults! This is not an epidemic of hate against LGBT individuals.

So, in a nation of 300 million people, there were only 242 "violent" crimes against homosexuals, bisexuals or drag queens in 2007. This is no epidemic of hate and local law enforcement does not need intrusive federal intervention to deal with such a miniscule number of crimes. 

TAKE ACTION: Contact your two U.S. Senators immediately and ask them to vote NO on S. 909 or any variation of H.R. 1913.

I can't believe that the House version actually pa*sed. How ridiculous. Why don't we all claim to be "special" and then every possible slight towards someone else becomes a felony. That will solve the over crowded prison problem....riiiight.

I figured that everyone else on the hill would have seen this for what it is...Kennedy's life long political goal. That and an INSANE idea from a man that had a brain tumor. Pardon the pun, but there is no way this man is in his right mind. Perhaps a full frontal lobotomy would be a better use of our tax dollars.

While there is a considerable amount of discrimination against transsexuals specifically (who are not transvestites, or "drag queens," as you denigrate them (as the First Amendment allows you to, but it doesn't help either your presentation or your appearance)), about half of that is by other members of the gay community, who are quite willing to toss them under the bus as a bargaining chip for "rights" for upper cla*s white male gays like, say, Barney Frank.

I'm not sure how an order from our political betters on the left to "stop doing what we don't like you to do" is expected to have any effect. Orders to people not to speed, drink, do drugs or commit violence in general don't seem to have had much effect. It seems punishing each crime on its merits works, but is unpopular with that same left.

FYI, transsexuals are usually suffering from some genetic flaw that causes their genes to be messed up. Insulting them is on par with insulting the blind, the deformed, or Downs sufferers.

You people supporting these bills are not understanding the underlying point. ONE, I don't condone hate crimes and neither do the majority of the citizens of the United States. The argument is that there should not be EXTRA SPECIAL TREATMENT for these individual groups. TWO, everyone that commits an act of violence against another already is held accountable by the laws already in place. Why should there be ADDITIONAL punishment for crimes against a particular sexual preference, race, or religion? That is essentially saying that a crime against a homosexual is "twice" as "bad" as a crime against a WASP (white, anglo-saxon, protestant). Besides the fact that proving that the crime was motivated by one of these factors is not as easily a*sertained a*sumption. This is ludicrous! On what Constitutional grounds are you given special treatment because you are different? The answer? YOU ARE NOT. That is why these bills are completely unconstitutional and therefore, against the law. That is why the states are SUPPOSED to be given the right to VOTE on the issues that are most relevant to their constituents and not the role of BIG GOVERNMENT to force others to be punished for speaking out against what they feel is wrong. There is a reason why "middle America" does not follow lock step with those in California or Ma*sachusetts. There is a REASON why people live where they choose to live. People tend to live around those most like them…or they just accept their environment in an apathetic tone. Read both the House bill and the Senate bill before you blindly speak about it.

In 2004, the U.S. State Department issued a report on Global Anti-Semitism, whereby they called for "Hate Crime Legislation" to correct any mistreatment or insult to Jews. According to the report (go read it) the New Testament is not only offensive to Jews, it is blamed, partially, for the Holocaust. This was 2004. I don't think Obama had anything to do with the State Department in 2004.

Wow you are all hateful and ignorant. Yes there is a migration with LGBT people, they all tend to flee the hick towns they come from to find refuge in San Francisco. The straight white male does not need special treatment because he is not a minority, where as anyone who is cla*sified as different is. Chances are that if your a straight white male you can do simple tasks like buying groceries without receiving hara*sment from people. I dare all of you to pretend to be gay for a week in public and see how many people call you a fag, give you weird stares, and make fun of you. Try to stay happy when you've had a bullied day. You won't tolerate it. Bottom line is Gay people struggle with society more than you'll ever do. Your life isn't a constant battle, you don't have any enemies like they do. When do you hear on the news about a person being killed ONLY for being a straight white male? Never. A lesbian woman was recently raped here in Richmond, California. When has a straight white male been raped for being a straight white male? You people have pure hate in your heart and I'm sure most of you identify as Christian yet your actions and words are not saintly. What gives you the right to attack me and/or murder me for not sharing the same beliefs as you? I obviously don't agree with your views but that doesn't mean I should have a pa*s to violence against you. Your not a true American. America is supposed to be the land of the free and diverse. The persecuted would come here to escape. Using your religious beliefs as an excuse to take away minorities rights is not American. Every human is unique and not all of us share the same opinion. There's people who don't believe in God and think it's a fairy tale, should they be allowed to close down churches and use "There has been no proof or evidence of a God existing" as their excuse? No, so the same should be for the other. Two men kissing is not going to affect your life, it has no impact on it so why should you pathetically and desperately protest against it? Let me use a simple tongue-in-cheek example: I don't agree with the way Paris Hilton lives her lifestyle but I'm not gonna protest to have her rights taken away.
