Obama Immigration Policy Begins to Take Shape: Amnesty by Administrative Inaction Print E-mail

Over the coming months Americans will find out if the Obama administration and the congressional leadership are preparing another attempt to pass a comprehensive amnesty bill in 2009. But, with or without legislation, the administration is sending unmistakable signals to illegal aliens that they will not vigorously enforce laws against illegal immigration. Just as increased worksite enforcement during the past two years was beginning to show a positive effect, and illegal aliens were starting to return home, the actions of the new administration are likely to undo that progress.

Based on the administration's actions during their first two months in office, certain patterns are becoming evident:

Review of worksite enforcement policies. On February 24, Immigration and Customs Enforcement (ICE) agents raided the Yamato Engine Specialists Company in Bellingham, Washington, and arrested 28 illegal alien workers. This was the first worksite enforcement action carried out by ICE since the new administration took power.

Rather than support the ICE agents in the field for doing the job the taxpayers are paying them to do, Homeland Security Secretary Janet Napolitano called for a review of worksite enforcement policies. Testifying before Congress the next day, Napolitano told lawmakers that she had not been informed about the Bellingham raid. "I want to get to the bottom of this," said Napolitano.

The secretary's statement to Congress came in response to howls of protest from pro-illegal alien activists who demanded that ICE enforcement cease immediately. The decision to review ICE enforcement efforts, rather than offer unqualified support for the people enforcing U.S. immigration laws, indicates that the Obama administration is likely to curtail worksite enforcement.

Ironically, the raid was carried out on the same day that the president addressed a joint session of Congress during which he vowed to fix the economy and get unemployed Americans back to work. Hundreds of American workers immediately applied to fill the 28 jobs left vacant by the arrest of illegal alien workers at the Yamato Engine Specialists Company in the town about 20 miles from the Canadian border.

Nationwide, an estimated 7.7 million U.S. jobs are now held by illegal aliens. In case after case in which enforcement actions have removed illegal workers, legal workers have almost immediately lined up to fill the vacancies. American DO want these jobs. These are jobs that can and should be available to U.S. workers at a time of rising unemployment, without spending $800 billion.

If you're not a terrorist or a felon, there is no need to worry. In other statements since taking office, Secretary Napolitano has hinted that her department's enforcement efforts will focus on tracking and removing terrorists and criminal aliens from the country. While no one can argue with the objective of removing foreign terrorists and criminals, the administration's statements indicate that those who entered the U.S. illegally will not be pursued unless they are terrorists or felons.

The first target may be 287(g) enforcement. The provision, established in 1996, allows state and local police to receive training in immigration law enforcement for the purpose of supplementing limited federal law enforcement resources. It provides an important and necessary tool to help law enforcement officers protect their communities. Under the 287(g) program, which FAIR fought to include in the 1996 legislation, 67 police and sheriff's departments across the country have received training to identify and detain suspected illegal aliens. Last year, 43,000 illegal aliens were arrested by 287(g) trained officers.

This highly effective enforcement tool is now under attack by the defenders of illegal aliens because some of those apprehended are not violent felons, according to a review by the Government Accountability Office (GAO). Based on these findings, House Homeland Security Committee Chairman Bennie Thompson (D-Miss.) indicated that the program may come under review. "[T]he record is incomplete, at best, as to whether this program is a success," Thompson said.

The legislative language creating 287(g) did not specify that it be used exclusively, or even predominantly, to apprehend criminal aliens. Rather, the GAO report notes, "its legislative history do[es] not detail the exact responsibilities to be carried out" by local law enforcement. The report also states that "ICE has the discretion to define the 287(g) program objectives in any manner that is reasonable," thereby playing into the hands of the Obama administration by suggesting it can decide to use the program solely to identify and remove terrorists and criminal aliens.

What is taking shape is a hands-off policy for all illegal aliens, except those engaged in violent crime or terrorism. Even without a formal amnesty, the Obama administration appears to be moving in the direction of allowing all but the most incorrigible illegal aliens to remain and work in the United States. Moreover, the president did not demand inclusion of E-Verify protections in his economic stimulus package, aimed at creating or preserving some 3.5 million U.S. jobs.

FAIR will continue to press for vigorous enforcement of U.S. immigration laws - especially at a time of economic crisis - in spite of the administration's apparent obstructionism. Working with allies in Congress, the media, and a dedicated core of committed activists across the country, FAIR will challenge every effort by the administration to ignore its responsibilities to law-abiding workers and taxpayers.

The refusal by the Obama administration to carry out enforcement efforts also provides a powerful argument against future amnesty legislation. It is an early indication that any enforcement promises made in exchange for amnesty legislation are likely to be worthless and the failures of the 1986 amnesty law repeated.

North American Union is the real goal of the pro illegal alien supporters

Why are the elite, and politicians of both parties, refusing to enforce our democratically pa*sed immigration laws, substiting the will of the few for the decision of Americans?

Well Canandian politicians have acknowledged the goal of forming a North American Union. Ex President Fox of Mexico recent adressed a Latino American group and clearly stated that was Mexicos's goal. Check out the Judicial Watch website and see the Bush government document stating that as Americans would resist union, it has to be done by "evolutionary stealth"

It sure does explain the open southern border policy (DHS says 70% of illegal aliens are Mexican), the refusal to enforce our laws, the promotion of Spanish as a second language equal to English here, the buildilng of the North American Highway, letting Mexican truckers into the US, and the integration of American, Canadian and Mexican infrastructure that is occurring.

A Union migh tbe a good idea. Buit Americans should be told the truth. We should be able to vote on it like iwhat happened tin Europe. There should be protections for our nation, culture and language like in Europe.
Instead, the "elite" want to force it on us, and as long as their profits soar, they could care less about our nation.

If we do not act now, all that will be left is to ask the last person in the country we once called America to lower the flag one last time.

ILLEGAL ALIENS

I can't say the ILLEGAL ALIENS are completely to blame for the shape of our economy, but they are a BIG part of the problem. The ILLEGAL ALIENS send BILLIONS upon BILLIONS out of this Country every year, money we will NEVER see again. Does this help our economy?

How about the BILLIONS the American taxpayers fork out for the ILLEGAL ALIEN BABIES, the schooling of them, the medical care and the list goes on, and on, and on.

How about the MILLIONS upon MILLIONS paid to jail ILLEGAL ALIENS for the crimes, then the cost to deport them. Does this help our economy?

Then you have these activist groups, the Catholic Church and the ACLU that want AMNESTY for these ILLEGAL ALIENS. It would be absolute suicide for this Country if AMNESTY were granted to the 20 million or so ILLEGAL ALIENS. We have more and more people out of work everyday and they want to add another 20 million to this Country? I say, "NO"!

If AMNESTY were ever granted to these 20 million ILLEGAL ALIENS, you can bet big money that 3 years from now, there would be ANOTHER 3-5 million ILLEGAL ALIENS demonstrating on our soil for AMNESTY.

An end MUST come to this illegal immigration. The perfect tool we have so far is E-Verify. It MUST be used by ALL businesses and Government Social Services. EVERY employee must be checked! If they are illegal, they are to be dismissed!

I believe it is time for all 50 States to pa*s a State law, like Arizona, Oklahoma, Mississippi, Missouri, South Carolina and a few others. It is time for these ILLEGAL ALIENS to go back to their home Country and get out of this Country. The problems they are causing will not go away until the ILLEGAL ALIENS are out of this Country.

ok, for all of you who think that the illegals are the problem, you don't know beans.
I am an ALIEN. And my husband was an ILLEGAL ALIEN. He went back to his country so he can come back here legaly. My ILLEGAL HUSBAND had a Social Security Number that was issued by this country on HIS NAME. He got paid with a check every week and of course taxes were taken out. He had been here for 8 years and filed taxes ALL 8 years. When he would apply for health care, guess what? He couldn't get anything because he had no valid visa. When he tried to go to school he couldn't because he had no valid visa. And when he got arrested to get deported I said i wanted to pay for his trip back home because i didn't him to wait around in jail until they found one for him, they said NO! So i don't get what the problem is. And please READ about the immigration before you speak because i don't see how THEY are the ones causing our economy to be the way it is.

Why is President Obama pondering another Amnesty, when back in 1986 the Sinpson/Mazzoli bill was made law? It was signed by Ronald Reagan and Liberal Sen.Ted Kennedy swore their would never be another AMNESTY. The Act made it illegal to knowingly hire or recruit illegal immigrants, requiring businesses to attest to their workers immigration status. The law granted amnesties to certain illegal aliens who entered the United States before January 1, 1982 and who had resided here continuously. It was mainly for the sake of 3 million agricultural workers, but once again was mired in fraud and dishonesty. It might have worked, except the next waves of illegal families started pouring through wide open border, demanding even more rights from the American people. So the question simply is? Why ANOTHER AMNESTY? It’s because previous administration intentionally never intended to enforce the laws back then or today! Kennedy certainly didn't? As usual the American people have been played for fools! Anything that smells of rigid enforcement has been killed or weakened, to clear the way for the free movement of cheap labor. Instigated by free trade entities and clandestine progress towards a North American Union, that represents a direct attack on our Constitution. The heritage Foundation has analyzed the consequences of a new AMNESTY. Which will not only give 40 million illegal families, even more access to government benefits? Then afford them the right to sponsor whole families, whom will end up being another financial burden on taxpayers.

Unlike the last Amnesty the people are very much informed via the Internet of the consequences, and will lay siege to every Senator or Representative. Just like E-Verify and other new enforcement laws we will try to kill any new Amnesty. We should demand use the 1986 act (IRCA), and strictly enforce its laws as it was intended?

You guys are stupid! money goes in and out of this country through all sorts of different ways! you take money out of this country when you go on vacation to europe or whenever you buy a chanel bag! (not that you can afford one!!) don't blame it on people who are just trying to make an honest living working jobs that the so called "americans" don't want to work! They still have to pay to live here for housing and food and expenses, they still pay taxes so don't say that only "american" tax payers are paying for those medical fees and schools because everyone in this country is paying for it. America is a country of immigrants, you are all immigrants! there are mexicans here who have lived in all their lives and are americans, just because they don't have a piece of paper saying they are, does not mean that they weren't raised american. Do not blame this economic failure on people other than yourselves. All the government and the american industries care about is about making fast money, they never think towards the long run. IDEAS need to change or else the economy is just going to fall apart.

Stop being so selfish realize that we live as a world of people, other people exist outside the United States!

amnesty should be granted to those who deserve it, and you don't have to be a certain race to be seen as a person in this country, you should be better than that.

JC, the ad hominem attack - where you say someone is stupid - does not do anything to further your position. It would be nice if you could do a better job of substantiating your position but you don't seem to have very much to work with.
