The Fourth Circuit Court of Appeals upheld the conviction of Maryland resident Ali Asad Chandia for providing material support to Lashkar-e-Taiba but vacated his fifteen year prison sentence ruling that "the acts underlying the conviction...were not violent terrorist acts...Therefore, these acts cannot, standing alone, support application of the terrorism enhancement."
As DOJ noted in a press release on Chandia's sentencing, "during a three-month trip to Pakistan in 2001-2002, Chandia met and allied himself with Mohammed Ajmal Khan...Khan, who is currently serving a nine-year sentence in the United Kingdom for directing a terrorist organization...served as a military procurement official for Laskhar-e-Taiba."
Moreover, in "a search of Chandia's home...the FBI found...materials manifesting his commitment to violent jihad." And "on the front seat of Chandia's car, the FBI...found a CD-Rom containing videos glorifying the September 11, 2001, terrorist attacks..." The Chandia investigation was part of the "Virginia Jihad" probe that led to a number of other convictions, including that of Ali Al-Timimi, the group's spiritual leader. Chandia served as Al-Timimi's "personal assistant."
